1. Acceptance of Terms

By downloading, installing, or using Prettify ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Prettify is a mobile application that provides:

• AI-powered beauty analysis and skin assessments
• Personalized skincare recommendations and routines
• Product suggestions
• AI beauty coach chat (coming soon)

3. User Accounts

• You must be at least 13 years old to use this App
• You are responsible for maintaining the confidentiality of your account
• You are responsible for all activities that occur under your account
• You agree to provide accurate information when creating your account

4. Subscriptions & Purchases

Free Tier

• Your first beauty analysis is free
• Feature summary is always visible

Prettify Premium (Subscription)

• Prettify Premium unlocks detailed skin observations, personalized routines, and product recommendations
• Price: $4.99 per month
• Free Trial: 14-day free trial for new subscribers
• Auto-Renewal: Your subscription automatically renews each month unless cancelled at least 24 hours before the end of the current billing period
• Cancellation: You can cancel anytime in your device's Settings → Apple ID → Subscriptions. Cancellation takes effect at the end of the current billing period — you retain access until then
• Payment: Payment is charged to your Apple ID account at confirmation of purchase. Your account is charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price

Billing

• All purchases and subscriptions are processed through Apple's App Store
• We do not collect or store your payment information
• Refund requests are handled by Apple through the App Store

5. User Content

• You retain ownership of photos you upload
• By uploading photos, you grant us permission to process them for beauty analysis
• We do not store your photos after analysis
• You may only upload photos of yourself. Uploading photos of others without their consent is a violation of these Terms and may result in account termination.
• You are solely responsible for the content you upload

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Upload inappropriate or offensive content
• Attempt to gain unauthorized access to the App or its systems
• Use the App to harass, abuse, or harm others
• Reverse engineer or attempt to extract source code
• Use automated systems or bots to access the App
• Attempt to circumvent rate limits or abuse API endpoints

7. AI-Generated Content

• Beauty analyses, recommendations, and chat responses are generated by AI
• We do not guarantee the accuracy of AI-generated content
• Product recommendations are suggestions, not endorsements — shade names and formulations may vary
• You should consult with professionals for medical or dermatological concerns
• AI-generated content is not a substitute for professional medical advice

8. Product Recommendations & Affiliate Links

• The App may recommend products and provide links to purchase them
• Some links contain affiliate tags — we may earn a commission on purchases made through these links
• Affiliate relationships do not influence which products are recommended

9. Intellectual Property

• The App and its content are protected by copyright and other intellectual property laws
• You may not copy, modify, distribute, or create derivative works
• The Prettify name, logo, and branding are our trademarks

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy of AI-generated content

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Any damages exceeding the amount you paid us in the past 12 months

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App. Your continued use after changes constitutes acceptance of the new Terms.

14. Termination

• You may terminate your account at any time through the App's Settings
• We may terminate or suspend your access for violations of these Terms
• Upon termination, your right to use the App ceases immediately
• Termination does not automatically cancel your subscription — manage subscriptions in your Apple ID settings

15. Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

• Informal negotiation
• Mediation in Lausanne, Switzerland
• Binding arbitration if mediation fails

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and Prettify regarding your use of the App.
